    Following the European Commission Recommendation of 26 July 2017 regarding the rule of law in Poland (C(2017) 5320 final), the Polish Minister of Foreign Affairs wrote a letter to the First Vice-President of the European Commission requesting him to clarify and specify certain issues covered by the Recommendation.

    Poland has found a number of inaccuracies in the Recommendation that need to be addressed in order for it to be able to formulate a response concerning the actions recommended to Poland by the European Commission.

     

    The questions and doubts raised by the Polish side concern the legal basis of certain solutions proposed to Poland by the Commission, references to specific EU legal acts on the basis of which the Commission assesses the ongoing Polish reform of the judiciary, and more details about some of the Commission’s recommendations, among others.

     

    It is necessary for the Commission to address the questions and doubts raised by Poland in order to continue an effective merit-based dialogue.
